Report on the transposition of enterprise crisis legislation
The Report responds to two specific objectives: to illustrate in detail the content of the European Directive 2019/1023 on restructuring and insolvency, delving into its essential contents (preventive restructuring, early warning, dismissal) and the reasons for its transposition; to analyse how the Directive has been transposed in the EU Member States, through the analysis of the national implementing laws in different EU (project partners) and non-EU countries (Albania, Bosnia and Herzegovina, North Macedonia, Serbia), comparing its contents and the differences in its implementation. Best practices and critical issues that emerged from the study of the transposition of European legislation on business crises in the various national contexts will also be highlighted.
Survey on the level of knowledge of micro and small enterprises
The survey aims to investigate the level of knowledge of micro and small enterprises on the regulatory obligations emerging from the EU Directive 2019/1023, as well as the reasons that led the European Union to adopt this measure. We will pursue this objective by administering a questionnaire to micro and small enterprises and conducting a fact-finding survey to analyse their awareness of the new EU rules on restructuring and insolvency.
Documentation platform
The platform will allow us to deepen and detail the European Directive 2019/1023 content on corporate restructuring and insolvency. Furthermore, it will enable us to analyse in detail how the Directive has been transposed by the different EU Member States, comparing the contents of the respective national implementing laws. Finally, the platform aims to understand the degree of awareness of micro and small enterprises regarding the regulatory obligations arising from the Directive and the reasons that prompted the EU to adopt this regulatory measure. The platform will be constantly updated by sharing and disseminating all the results of the project activities.
